Terms of Use – KOMER (MVP Phase)

1. Scope of the Platform and MVP Phase

KOMER SARL is a company registered in Cameroon and operating under the trade name "KOMER." KOMER is a mobile delivery application that allows users to order meals, medicines, and grocery products from partner vendors.

During the MVP phase, the app is active in Yaoundé and Douala. Some features may be limited or unavailable (no chat, certain operations processed manually, ongoing bug fixes). KOMER acts solely as a technology intermediary and does not directly provide products or transport services.

2. Eligibility and Account Creation

To use KOMER, the user must:

  • Be at least 18 years old.
  • Register with a valid phone number and OTP verification.
  • Accept these Terms of Use and the Privacy Policy.

Accounts are personal and non-transferable. The user is responsible for keeping their login credentials confidential.

3. Available Services

During the MVP phase, KOMER allows users to:

  • View vendor menus or catalogs.
  • Place and confirm orders online.
  • Pay via Mobile Money (Orange Money, MTN MoMo) or bank card (where available).
  • Track deliveries via the KRIS system.

Product availability is not guaranteed. Each vendor is responsible for the accuracy of the information displayed.

4. Vendor Requirements

Vendors must:

  • Keep menus, prices, and stock up to date.
  • Prepare orders carefully and promptly.
  • Use only the KOMER vendor dashboard.
  • Not accept payments outside the app.

KOMER may suspend a vendor for non-compliance with these rules.

5. Rider Requirements

Riders:

  • Are independent contractors.
  • Use the rider app to receive and complete orders.
  • Must comply with the law and performance standards.

KOMER does not provide insurance or equipment (other than delivery bags).

6. Payments

All transactions are made via Mobile Money (Orange Money, MTN MoMo). Cash payments are not allowed.

  • Payment is captured at the time of order.
  • Vendor and rider payments are made after delivery, according to KOMER's MVP payment schedule.
  • The user must ensure their mobile wallet has sufficient funds.

7. Order Cycle

  1. Vendor is selected and order placed.
  2. Rider assigned via KRIS.
  3. Real-time tracking.
  4. Delivery and final payment confirmation.

Target average delivery time: under 35 minutes, not guaranteed.

8. Cancellations, Modifications, and Refunds

  • Free cancellation before rider assignment.
  • Possible fees after rider assignment.
  • Refunds handled on a case-by-case basis.
  • KOMER may cancel orders due to unavailability, force majeure, or technical issues.

9. Support and Disputes

During the MVP phase, support is only available by email: info@komer.io

KOMER acts as a mediator but requires proof for any claim.

10. Limitation of Liability

KOMER accepts no liability for:

  • The quality or safety of products sold.
  • Delays or incidents caused by traffic or third parties.
  • Rider conduct outside the app.
  • Network outages or mobile payment failures.

Maximum liability: the value of the affected order.

11. Platform Abuse

Prohibited actions:

  • Fraudulent orders or system misuse.
  • Harassment of riders, vendors, or KOMER staff.
  • Fraud to obtain rewards.

Penalties: account suspension or deletion.

12. Data Protection

KOMER collects only the data necessary to provide the service.

No sale of data to third parties.

Data is stored securely in compliance with Cameroonian law.

13. Changes

KOMER may update these Terms without notice.

Continued use of the app after changes constitutes acceptance.

14. Account Deletion

Users can request deletion of their account and all associated data directly in the KOMER app:

  • Open the app
  • Go to Profile → Settings → Delete Account
  • Confirm deletion

Once confirmed, your account and all personal information (name, phone, email, address) will be permanently deleted from our system.
